With a shocking 2-1 panel ruling, the US Court of Appeals for the Fourth Circuit, federal judges held up a lower court’s ruling. Filed by parents at the Montgomery County Public Schools (MCPS), they wanted to prevent K-5 students from being indoctrinated with gender identity and sexuality curricula. Simply seeking that the school be required to obtain permission from the parents, the lower court ruled in March 2023 that there wasn’t enough evidence to prove a religious violation.
President Bush’s appointee, Judge G. Steven Agee, penned the majority opinion about their lack of evidence.
“We take no view on whether the Parents will be able to present evidence sufficient to support any of their various theories once they have the opportunity to develop a record as to the circumstances surrounding the Board’s decision and how the challenged texts are actually being used in schools. At this early stage, however, given the Parents’ broad claims, the very high burden required to obtain a preliminary injunction, and the scant record before us, we are constrained to affirm the district court’s order denying a preliminary injunction.”
Comprised of Muslim, Jewish, and Christian parents, they claim the district’s refusal to allow them to opt out of the books denies them the ability to raise kids according with their faith. With titles like “The Pride Puppy,” “Uncle Bobby’s Wedding,” and “Born Ready: The True Story of a Boy Named Penelope,” they are grossly perverse. Sending kids on “I Spy” style games, they are asking kids to be on the lookout for people in drag, showing their underwear, or wearing bedroom attire.
According to the panel,, just hearing about these things isn’t going to make the kids act out from what they hear or go against their faith. Given this kind of mindset, perhaps we should start removing all warning labels and censorship. Why bother with TV or movie ratings since just watching or hearing about things won’t make people follow their lead, according to these judges? It’s pathetic how spinless these judges have gotten in the name of being woke.
